SHC suspends appointment of Gadap Town administrator

Sindh High Court (SHC) on Thursday suspended the appointment of Gadap Town’s administrator and issued notices to the advocate-general and others for February 21 on a petition.

The petitioner Nazimuddin, who is a social worker, had submitted in the petition that the appointment of Munawar Ali Siyal as administrator Gadap Town was unlawful and against the procedure for the appointment of administrators.

The petitioner’s counsel, Nawaz Sheikh, submitted that the government on February 23, 2010 promulgated a law providing the procedure for the appointment of administrators in terms of Section 2 of the Local Government Ordinance.

He submitted that according to the procedure the government was to appoint the administrator from amongst the civil servants, including employees of the local government and the government of Sindh, and officers of the council unified grade service (CUGS).

However, the respondent was appointed bypassing the relevant procedure. The petitioner said that the respondent was a retired officer of the CUGS and by no stretch of imagination could he could be appointed as administrator. He prayed to court to suspend the notification of the respondent, saying that he (the respondent) was plundering the funds of the town.

A division bench of the SHC, headed by Justice Sajjad Ali Shah, after conducting the preliminary hearing into the petition, observed that the contention raised by the petitioner required consideration.

The court issued notices to the advocate-general, Munawar Ali Siyal, and others for February 21, and suspended the impugned notification on the appointment of the administrator.
